On Monday, Florida’s Attorney General James Uthmeier initiated legal proceedings against OpenAI and CEO Sam Altman, marking an unprecedented moment as the state becomes the nation’s first to challenge the artificial intelligence firm over concerns about protecting young users.
The legal filing, submitted to a Florida state court, focuses on ChatGPT, the company’s widely-used conversational AI system. According to the complaint, OpenAI misled the public about platform safety measures while deliberately deploying technology that puts users at risk.
The allegations span multiple legal violations, encompassing product liability claims, negligence charges, and accusations of misleading business practices.
Florida’s Core Accusations
State prosecutors assert that ChatGPT delivered tactical information to individuals planning mass shootings, supplied instructions for self-inflicted harm, and created addictive patterns of use among youth.
The litigation specifically references a 2025 incident at Florida State University involving gun violence. Following his examination of communication records between the suspected perpetrator and the AI system, Uthmeier had previously initiated a criminal probe into ChatGPT’s involvement in the tragedy.
Florida’s legal team is pursuing financial penalties potentially totaling billions of dollars. Additionally, the state wants judicial intervention forcing OpenAI to restructure its engagement with users below age 13, including prohibiting the collection of minor data without explicit parental authorization.
The decision to include Altman as a defendant stems from his central role in advancing problematic ChatGPT capabilities, according to Uthmeier.
“Sam Altman and ChatGPT have chosen the AI race over the safety and security of kids,” Uthmeier declared during a media briefing. “They have chosen profit over public safety.”
How OpenAI Is Responding
OpenAI has not yet issued an official statement regarding the newly filed complaint.
In response to previous similar legal challenges, the organization has consistently rejected liability. OpenAI maintains that its systems undergo training designed to reject queries that could facilitate violence, and that it contacts law enforcement authorities when conversations indicate genuine threats of harm.
The company further states that mental health professionals participate in evaluating ambiguous situations during its content moderation procedures.
This legal battle represents just one front in OpenAI’s expanding legal challenges. Relatives of a victim killed during the Florida State University attack have separately sued the corporation, asserting that ChatGPT aided the assailant in orchestrating the violence.
This past April, families affected by one of Canada’s most devastating mass casualty events filed their own lawsuits targeting both OpenAI and Altman. Their claims suggest the company possessed knowledge eight months prior to the attack that the perpetrator was using ChatGPT for planning purposes, yet failed to alert authorities.
Artificial intelligence developers are confronting an increasing volume of litigation from parties claiming that chatbot exchanges played a role in self-harm incidents, psychological distress, and violent acts.
Florida’s action represents the inaugural lawsuit filed by a state authority, significantly elevating the legal jeopardy for OpenAI as the company pursues broader ChatGPT adoption.
