The state of Maharashtra has moved forward with the DELTA Act, designed to establish comprehensive regulations for blockchain-based real estate tokenization throughout the region. This legislative initiative seeks to transform immovable assets into digital tokens while enabling secure, regulated transactions. The proposal has now progressed to the legislative drafting phase, where it will be refined before presentation to lawmakers for final consideration.
Creating Regulatory Structure for Blockchain Real Estate Assets
Chief Minister Devendra Fadnavis conducted an official review of the proposed legislation during a government session held in Mumbai on July 20, 2026. Government officials were directed to formulate the necessary regulatory architecture supporting the DELTA Act. Development continues as numerous legal and compliance components await resolution.
The legislative proposal aims to codify standards governing the creation and transfer of blockchain tokens representing immovable assets. This framework is designed to deliver legal clarity while safeguarding property rights throughout digital exchanges. Additionally, the initiative addresses challenges in monetizing assets that currently lack liquidity.
State authorities project that real estate tokenization could activate approximately ₹50 trillion—roughly $595 billion—in underutilized holdings. Officials view the DELTA Act as a cornerstone of their economic expansion blueprint. This program directly contributes to Maharashtra’s objective of achieving a $1 trillion economy before 2030.
Specialized Panel to Design DELTA Act Architecture
Fadnavis directed the Urban Development Department alongside the Law and Judiciary Department to convene a specialized advisory panel. This committee will architect the comprehensive legal infrastructure underpinning the DELTA Act. The panel will comprise delegates from SEBI, BSE, NSE, alongside legal professionals, financial advisors, and blockchain technology specialists.
Committee members will establish how blockchain property tokens operate within India’s legal system. Critical determinations include whether tokens constitute ownership documentation, investment vehicles, revenue entitlements, or regulated securities. These classifications will shape trading protocols, custodial standards, and supervisory frameworks.
The advisory group will examine international precedents and operational frameworks before finalizing legislative recommendations. The DELTA Act must harmonize with federal regulations governing property registration, fiscal policy, securities law, foreign capital requirements, and financial crime prevention measures. Upon passage, this legislation would mark India’s first state-level statute specifically addressing blockchain-based real estate tokenization.
Property Token Initiative Broadens India’s Digital Asset Discussion
Blockchain tokenization transforms property-related entitlements into digital instruments maintained on distributed ledger systems. Proponents anticipate accelerated transaction processing, verifiable ownership documentation, and enhanced fractional ownership possibilities. Divisible ownership structures could democratize access to premium real estate investments.
Blockchain infrastructure alone cannot eliminate title disputes or rectify defective land documentation. Regulators must therefore create legally binding connections between digital tokens and government property databases. The regulatory framework must additionally accommodate succession planning, lending arrangements, restricted properties, credential recovery, fraudulent activity, and conflicting title assertions.
This legislative initiative emerges amid expanding dialogue surrounding real-world asset tokenization across multiple Indian policy channels. GIFT City has already facilitated regulated tokenized property instruments operating under current financial statutes. Concurrently, the Reserve Bank of India maintains restrictive policies regarding cryptocurrencies while acknowledging broader blockchain utility. The DELTA Act could advance India’s tokenization infrastructure by providing statutory legitimacy to blockchain property documentation while maintaining established legal safeguards for landholding rights.
